United Airlines Flight Attendant Files $30M Lawsuit Against Airbus

CHICAGO- United Airlines (UA) flight attendant Darlene Fricchione is taking legal action against Airbus following a cabin air contamination incident on United flight UA2680 at Denver International Airport (DEN). She claims that her exposure to tainted air has led to severe and lasting health complications.

According to PYOK, the lawsuit asserts that the design shortcomings of the A319 aircraft contributed to the incident. Fricchione is seeking $30 million in damages, citing negligence and the failure to provide warnings about known hazards.

On April 11, 2023, Fricchione served on Flight UA2680, which traveled from LaGuardia Airport (LGA) to Denver International Airport (DEN).

After arriving and parking at the gate, the aircraft’s captain switched on the auxiliary power unit (APU) to manage cabin air conditioning.

Fricchione soon reported being exposed to air with a foul chemical odor, which triggered instant gagging, choking, and irritation in her eyes and skin.

In a detailed 23-page legal complaint, Fricchione recounts how she poured water over herself and gargled in an effort to ease her discomfort, remaining inside the aircraft until all passengers had exited.

Emergency medical responders discovered elevated blood pressure and carbon monoxide readings in both Fricchione and a colleague.

At a medical facility, an X-ray indicated a “cloud” on her lungs, leading to her receiving oxygen therapy. After returning to LaGuardia, her health deteriorated with worsening rashes, fainting spells, high blood pressure, and an increased white blood cell count, necessitating hospitalization.

Once healthy, Fricchione now endures chronic headaches, frequent nosebleeds, throat hypersensitivity, and potential high blood pressure linked to chemical exposure, as assessed by medical professionals.

Lawsuit Details

The lawsuit was filed in a Virginia district court, charging Airbus with negligence in aircraft design and failing to appropriately inform or train flight crews regarding the risks associated with contaminated air.

The allegations suggest a recurring issue: incidents involving Airbus aircraft reportedly occur more frequently compared to those from other manufacturers due to existing design flaws.

Fricochione’s legal team claims that Airbus has long been aware of these risks yet has failed to take necessary safety measures.

Proposed improvements, such as incorporating chemical sensors in air conditioning systems or enhancing air filtration, have not been implemented despite growing scientific and medical evidence underscoring the threats involved.

Over the years, flight attendants and passengers have reported occurrences of “fume events” or “odor events,” though terminology can differ.

Advocates characterize these incidents as toxic exposures, while manufacturers often downplay them as simple odors.

Regardless of terminology, the potential consequences can range from minor discomfort to significant, lasting health issues.

Ongoing Recovery

Following the cabin incident, Fricchione was admitted to the hospital due to elevated blood pressure and a heightened white blood cell count.

She is still experiencing chronic symptoms. Medical specialists, including pulmonologists and cardiologists, have attributed her ongoing health challenges to chemical exposure.

Currently, she is undergoing speech therapy to recover from throat damage likened to chemical burns.

The lawsuit contends that Airbus should have recognized the increased risks associated with using the APU on the ground and failed to enhance designs to safeguard against these situations.

Darlene is pursuing $30 million in punitive damages, citing long-term impacts on her physical, emotional, and professional well-being.

As of now, neither Airbus nor United Airlines (UA) has provided comments regarding the situation.
